Extension of Enforcement Delay

• Further extends the enforcement delay specified in section 2(a) of Executive Order 14166 until December 16, 2025.
• During this period, the Department of Justice will not enforce the Protecting Americans from Foreign Adversary Controlled Applications Act or impose penalties for noncompliance related to foreign adversary controlled applications.

Protection from Future Enforcement

• Even after the extension, the Department of Justice shall not enforce the Act or impose penalties for conduct during the specified period or before the issuance of this order (January 19, 2025, to the date of this order).

Attorney General Responsibilities

• The Attorney General is directed to issue written guidance to implement the order's provisions.
• A letter will be sent to each provider stating that there have been no statute violations and that there is no liability for conduct during the specified period or from the effective date of the Act until the date of this order.

National Security Concerns

• Emphasizes that state or private attempts to enforce the Act could encroach on Executive powers.
• The Attorney General will use authority to protect the exclusive enforcement authority of the Executive.

General Provisions

• The order does not impair the authority of executive departments or the Office of Management and Budget.
• Implementation is subject to applicable laws and available appropriations.
• This order does not create any enforceable rights or benefits against the United States or its departments.

Publication Costs

• The Department of Justice will cover the costs for the publication of this order.
